1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Qwickspark ("we," "us," or "our"), concerning your access to and use of www.qwickspark.com, any software development services we provide, and any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto. Qwickspark is primarily a software development services company — we build custom software for businesses and help founders build their product ideas — and we also operate our own products and free tools. We proudly serve and are trusted by organizations, brands, founders, and clients worldwide.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
Our product names, including SignForge, ClubSports.live, and Gymax, are proprietary properties and trademarks belonging to Qwickspark. Software we develop for clients under a services engagement is governed by the intellectual property terms of that specific engagement, not by this Site-wide policy.
3. User Representations
By using our services, you represent and warrant that:
- All registration or contract information you submit will be true, accurate, current, and complete.
- You will maintain the accuracy of such information and promptly update it as necessary.
- You have the legal capacity and you agree to comply with these Terms and Conditions.
- You will not use our platforms or applications (such as generating email signatures on SignForge or organizing physical brackets on ClubSports.live) for any illegal or unauthorized purposes.
4. Disclaimer of Warranties
Our services and SaaS products are provided on an "as-is" and "as-available" basis. You agree that your use of the site and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
5. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our proprietary suites, even if we have been advised of the possibility of such damages.
6. Governing Law and Jurisdiction
These Terms and Conditions and your use of our sites and systems are governed by and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts where Qwickspark India Services is registered, without regard to conflict of law principles.
7. QwickSpark Free Tools & Google Sign-In
Access to certain QwickSpark free tools — SignForge, FaviSpark, InvoiceGen, LogoCraft, and Q Notify — may require signing in with your Google account. By signing in, you agree that QwickSpark may use your basic Google profile information (name and email address) solely to identify your account across these tools, as described in our Privacy Policy.
These terms for Google Sign-In apply only to the QwickSpark free tools listed above and do not apply to ClubSports.live or Gymax, which are separate products governed by their own (or forthcoming) terms of service and privacy policies.
